Common types of slip and fall accidents occur when a person slips and falls on a foreign substance or snow and ice.
Massachusetts law states that where a foreign substance on a floor or stairway causes a person lawfully on the premises to fall and sustain injuries, that person may prove negligence on the property owner.

A person needs to determine what snow and ice removal efforts are reasonable in light of the expense they impose on the landowner and the probability and seriousness of the foreseeable harm to others. The snow removal reasonably expected of a property owner will depend on the amount of foot traffic to be anticipated on the property, the magnitude of the risk reasonably feared and the burden and expense of the ice removal. Therefore, while an owner of a single-family home, an apartment complex owner, a store owner, and a nursing home operator each owe lawful visitors to their property a duty of reasonable care, what constitutes reasonable snow removal may vary among them.

Premises liability refers to any type of accident caused by a condition on another’s property. Massachusetts property owners, landlords, business owners and owners of private and public premises have a duty to maintain their properties in a safe condition for all those individuals who enter their property. The property/business owner has an obligation to know about dangerous and potentially dangerous conditions and to correct those dangerous conditions within a reasonable time. The property/business owner also has a duty to warn visitors of know dangerous conditions that have not yet been corrected.

Massachusetts law limits lawsuits involving motor vehicle accidents, to injured victims who have suffered either certain types of injuries or to accident victims who have exceeded a certain dollar value of medical expenses as a result of their injuries. Massachusetts accident victims (and their survivors, if an injury causes death) may sue for damages from the responsible party(ies) for a car accident when one of the following criteria is met:

  1. The victim had died;
  2. The victim suffered a “permanent and serious disfigurement”;
